Terms of Service

These terms govern your use of Snacks4Sale, a digital service operated by Zyzyva LLC. By placing an order through Snacks4Sale, you agree to these terms. Please read them carefully — section 9, on dispute resolution, affects your legal rights.

1. What Snacks4Sale is

Snacks4Sale is a digital service that lets you order food from concession stands at venues — ballparks, fairs, and similar — using your phone. Depending on the venue, the service operates in one of two modes:

  1. Integrated mode — you pay for both the food and the Snacks4Sale convenience fee through your phone, and pick the food up at the venue's pickup point.
  2. Pay-at-counter mode — you pay only the Snacks4Sale convenience fee through your phone, which holds your spot in line; you pay the venue separately for the food itself.

Each venue's mode is reflected in the venue's ordering page before you check out.

2. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use Snacks4Sale and agree to these terms. By using the service, you affirm that you are.

3. What the convenience fee buys, and what it does not

The Snacks4Sale convenience fee — shown to you before you check out — pays for the digital service: queue management, order coordination, and kitchen and runner notifications.

The convenience fee does not pay for the food itself. The food is sold by the venue. Money you pay for the food goes to the venue, not to Snacks4Sale, and the venue is solely responsible for the food — its preparation, its quality, its safety, and any refunds that may apply to it.

Snacks4Sale is not the producer of the food. We do not cook it, store it, or guarantee its quality, freshness, or safety. If you have a problem with the food itself, that is between you and the venue. Snacks4Sale's role is limited to coordinating the order; we are not liable for any health or safety consequences of consuming food obtained through the service. We do not issue refunds on food charges — see our Refund Policy for details on which charges we can refund and which must be requested from the venue.

We display wait time estimates, not guarantees. Concession stands experience rushes, equipment failures, and supply outages we cannot predict.

We cannot guarantee that any specific menu item will be available when your order reaches the counter. Inventory at concession stands changes throughout an event, and the menu you see may be a snapshot that is minutes out of date. If an item you ordered turns out to be unavailable, see the refund policy.

6. Limitation of liability

Snacks4Sale's total liability to you for any claim arising out of or related to your use of the service — whether based in contract, tort, or any other legal theory — is limited to the amount of the Snacks4Sale convenience fee you paid for the order in question. This means: even if something goes wrong, the most you can recover from Snacks4Sale is the convenience fee you paid us for the specific order that was the subject of the dispute. We are not liable for any food charges, since those are paid to the venue and not to us.

This limit does not exclude liability that cannot be excluded under applicable law.

7. Refunds

Our refund policy is published at snacks4.sale/refunds. Please read it before requesting a refund. In short: we can only refund the Snacks4Sale convenience fee, never the food charge. Food refunds must be requested from the venue.

8. Account termination

Snacks4Sale reserves the right to refuse service or terminate your access at any time, with or without notice, for: fraud, repeated chargebacks for services rendered, abuse of staff, attempts to circumvent the convenience fee, or any conduct that could harm Snacks4Sale, the venue, or other customers.

9. Dispute resolution — please read carefully

Any dispute between you and Snacks4Sale arising out of these terms or your use of the service shall be resolved by binding arbitration, not in court, except for claims that qualify for small-claims court. Arbitration shall take place in the State of Tennessee and shall be conducted under the rules of the American Arbitration Association (AAA).

You and Snacks4Sale each waive the right to a jury trial. You and Snacks4Sale each waive the right to participate in any class action against the other; all disputes must be brought in your individual capacity.

If any portion of this arbitration clause is found unenforceable, the rest of the clause continues to apply, except that if the class action waiver is found unenforceable, the entire arbitration clause becomes unenforceable.

You may opt out of this arbitration clause within 30 days of first using Snacks4Sale by emailing admin@snacks4.sale with the subject line "Arbitration Opt-Out" and including your name and the date you first used the service. If you opt out, disputes will be handled in the courts described in the next section.

10. Governing law and venue

These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute not resolved under the arbitration clause above shall be brought in the state or federal courts located in Tennessee, and you consent to that jurisdiction.

11. Changes to these terms

We may update these terms. The current version is always available at snacks4.sale/terms with the date of the last update at the top. Continued use of the service after a change constitutes acceptance of the updated terms.
